Montana's workers' compensation system is a no-fault system. The Montana Workers' Compensation Act explicitly provides that benefits are available to workers suffering from work-related injuries or diseases without regard to fault. This is stated in 39-71-105, MCA, which outlines the public policy of the state to provide wage-loss and medical benefits to injured workers without considering fault 39-71-105, MCA.
The Montana Supreme Court has consistently upheld this principle, emphasizing that the system replaces the common law approach of proving employer negligence with a no-fault framework.
This no-fault system is part of a broader "quid pro quo" compromise, where workers give up the right to sue employers in exchange for guaranteed compensation, and employers gain immunity from tort liability while accepting limited and predictable responsibility for workplace injuries.
